Privacy Policy

PROQUERY Pty Ltd (“we,” “us,” “our”) operates ProQuery, ProQuery Insure, and ProQuery Deals (collectively the “Services”). We are fully committed to protecting your privacy and complying with South African law (especially POPIA) and, where applicable, GDPR.

1. Information We Collect We collect the following types of data depending on which Service you use:

All Services

• WhatsApp phone number and profile name

• Full chat history and messages you send

• Usage patterns and analytics

ProQuery (original)

• Any company documents you upload or link (SOPs, HR files, contracts, etc.)

ProQuery Insure

• Client personal and financial information you submit (ID numbers, income, medical history, risk details, existing policies, etc.)

• Documents uploaded for analysis (quotes, policy wordings, claims history)

ProQuery Deals

• Shopping lists, till slips, or bank transaction data (if you choose to connect them)

• Purchase categories and preferences

2. How We Use Your Data 

• To provide and improve the Services you are using 

• To generate answers, insurance reports, or deal recommendations

• For internal analytics and training of our AI models (anonymised where possible)

• To detect fraud or misuse 

• To comply with legal and regulatory obligations (e.g., FAIS, FICA, POPIA)

3. Data Sharing:

We only share your data when strictly necessary:

3. • With WhatsApp (Meta) – because the Services run on their platform

   • Cloud providers (AWS, Render) – for secure storage and processing 

   • For ProQuery Insure: with licensed South African insurers only when you explicitly request a quote or comparison (you will always be informed first) 

   • For ProQuery Deals: price and product data is scraped or received from public retailer websites and APIs – we never share your personal shopping data with retailers

   •  With law enforcement or regulators when legally required • With professional service providers (legal, auditing, IT security) under strict confidentiality agreements

4. User Rights (POPIA & GDPR) 

You have the right to:

• Access – see what data we hold about you 

• Correction – fix inaccurate data 

• Deletion – request removal of your data (subject to legal retention rules)

• Restriction or Objection – limit certain processing

• Portability – receive your data in a readable format

To exercise any right, email info@proquery.live – we will respond within 30 days (or faster where required by law).

5. Data Retention

   • Chat history & documents: kept for 3 years after your last interaction (or longer if required by insurance or tax laws)

   • Financial/insurance client data (ProQuery Insure): up to 5 years after the relationship ends (FAIS/FICA requirement)

   • You can request earlier deletion where we have no legal obligation to retain it.

6. Data Security 

We use bank-level encryption (AES-256), access controls, regular security audits, and store data in ISO 27001-certified South African and EU data centres.

7. Cross-Border Transfers 

Some processing happens on AWS servers in Cape Town or Frankfurt. All transfers outside South Africa are protected by Standard Contractual Clauses and adequacy decisions.

8. Compliance with Laws

We are registered with the Information Regulator in South Africa and fully comply with:

   • Financial Advisory and Intermediary Services Act (FAIS) – for ProQuery Insure

   • General Data Protection Regulation (GDPR) – for EU users

9. Breach Notification

If a breach occurs that risks your rights and freedoms, we will notify you and the Information Regulator without undue delay (within 72 hours where required).

10. Cookies & Tracking

The Services do not use browser cookies. Limited anonymous analytics are collected via WhatsApp and our backend for performance monitoring only.

11. Children’s Privacy

Our Services are not intended for persons under 18. We do not knowingly collect data from children.

12. Updates to this Policy

We may update this policy from time to time. Significant changes will be communicated via WhatsApp broadcast or email.
